Stephen Miller, top adviser to President Trump, said the White House is actively considering suspending habeas corpus, the constitutional safeguard against unlawful detention. Miller cited the Constitution’s provision allowing suspension “in Cases of Rebellion or Invasion,” saying undocumented immigration meets that threshold.

Miller accused “radical rogue judges” of blocking immigration enforcement and overstepping their authority. “The courts aren’t just at war with the executive branch,” he said. “They’re at war with the legislative branch as well.” He added that judicial interference with ending Temporary Protected Status for some immigrants also informed the administration’s stance.

Trump has long portrayed undocumented immigration as an invasion, invoking emergency powers to expedite deportations. The administration has clashed repeatedly with the judiciary and has defied rulings — including a Supreme Court order to facilitate the return of Kilmar Ábrego García, a man mistakenly deported.

A federal judge has threatened to hold the administration in contempt for failing to comply with that ruling.
