Donald Trump’s lawyers urged Judge Juan Merchan to dismiss his conviction for falsifying business records, claiming the case is politically motivated and legally unfounded. They pointed to President Joe Biden’s recent pardon of Hunter Biden as evidence of selective prosecution.

The Manhattan DA, Alvin Bragg, prosecuted Trump over hush money payments to Stormy Daniels. Trump was convicted on 34 counts in May, but his sentencing is postponed, with lawyers citing presidential immunity. They called the case “contrived” and argued it undermines the presidency, requesting dismissal in the “interests of justice.”

The motion rejected resuming proceedings after Trump’s term, calling it “ridiculous.” It also criticized the DOJ for past investigations into Trump, alleging political interference. Trump’s lawyers, Todd Blanche and Emil Bove, are expected to hold top DOJ roles if he returns to office.

The DA’s office has until Dec. 9 to respond and declined comment. A Trump spokesperson called the motion a “powerhouse” to end the case.
