President-elect Donald Trump has filed a legal brief urging a federal court to halt the Biden administration’s alleged sale of unused border wall materials. Trump’s team, citing a report by the conservative Daily Wire, claims the materials are being sold at significantly reduced prices in what it calls a “fire sale.”
The Biden administration’s actions align with last year’s National Defense Authorization Act (NDAA), which required the disposal of unused wall materials. The law, authored by Republicans, allowed for the materials to be sold or donated to states for refurbishing existing barriers but prohibited new installations. Administration officials state that all excess materials have already been distributed or sold, with some sold to the private company GovPlanet.
Trump’s brief argues that these sales obstruct his plans to resume border wall construction upon taking office, labeling the Biden administration’s actions as potentially unlawful. The filing also questions whether the transfer of materials from the Department of Defense to Homeland Security followed proper procedures.
During his first term, Trump constructed 458 miles of border wall, but only 52 miles were new structures. Efforts to halt or resume construction under Biden have faced legal and logistical challenges, including addressing incomplete segments.
