Former President Donald Trump plans to sue the Department of Justice (DOJ) for $100 million over the FBI’s raid on his Mar-a-Lago estate in August 2022. The raid, which was part of an investigation into Trump’s handling of classified documents, led to a 37-count indictment against him. However, these charges were dismissed last month by U.S. District Judge Aileen Cannon, a Trump appointee, who ruled that the appointment of Special Counsel Jack Smith to prosecute the case violated the U.S. Constitution’s Appointments Clause.
Trump’s legal team claims the FBI’s actions were “unconstitutional” and amounted to “malicious prosecution,” with Trump arguing that the raid was an unwarranted intrusion on his privacy. The DOJ has six months to respond to Trump’s notice of claim. Trump’s attorney also accused the DOJ of using the investigation as a political tool to prevent Trump’s reelection, further alleging that the prosecution was aimed at influencing the electoral outcome.
