U.S. District Judge Stephanie Gallagher on Thursday permanently blocked two Trump administration memos that threatened to withhold funding from schools with diversity, equity, and inclusion (DEI) programs.
Earlier this year, the administration issued a “Dear Colleague” letter to universities warning they could lose funding if they did not end “illegal” DEI efforts, and later sent K-12 districts a memo requiring certification that no DEI practices were in place.
The American Federation of Teachers, Democracy Forward, and other groups sued, arguing the actions bypassed Administrative Procedure Act requirements and violated constitutional rights. Gallagher, appointed by President Trump, agreed, writing that neither action was properly enacted and both infringed on “important constitutional rights.”
Democracy Forward president Skye Perryman called the ruling “an invaluable decision” for public schools, teachers, and students. The administration had argued the memos were needed to enforce the Supreme Court’s 2023 affirmative action ruling, which it claimed extended to scholarships and other programs.
