The Department of Homeland Security has approved a waiver allowing U.S. Customs and Border Protection to bypass environmental regulations and immediately resume construction of the southern border wall in California.

DHS Secretary Kristi Noem issued the waiver — her first since taking office — under the 1996 Illegal Immigration Reform and Immigrant Responsibility Act. The move clears the way to build 2.5 miles of wall in areas of high illegal immigration: Jacumba Hot Springs and San Diego.

“To cut through bureaucratic delays, DHS is waiving environmental laws — including the National Environmental Policy Act — that can stall vital projects for months or even years,” DHS said in a statement.

Construction includes two miles of wall in the Jacumba Gap Wall Project, 350 feet in Smuggler’s Gulch near Imperial Beach, and another 1,500 feet in a location designated as “4.”

The project is funded through CBP appropriations from fiscal years 2020 and 2021.

President Trump previously funded over 700 miles of border wall during his first term. The Biden administration canceled unfinished segments in 2021, though some funds remain for projects like this.
