President Donald Trump’s administration is facing a federal lawsuit over its plan to impose a $100,000 fee on new H-1B visas for highly skilled foreign workers. The lawsuit, filed Friday in the U.S. District Court for the Northern District of California, is backed by a coalition of religious organizations, health care providers, unions, and higher education groups.

Democracy Forward, which is leading the legal challenge, warned the policy would devastate critical sectors. “Hospitals will lose medical staff, churches will lose pastors, classrooms will lose teachers, and industries across the country risk losing key innovators,” the group said in a statement. The lawsuit seeks an immediate injunction to block the order.

Trump signed a proclamation on September 19 establishing the new visa fee, arguing the program has been abused to replace American workers with lower-paid foreign employees. The White House said the fee would be a one-time charge for future H-1B applicants.

Critics, including American Association of University Professors President Todd Wolfson, said the move undermines U.S. competitiveness and higher education. “He’s sending a message: ‘You’re not welcome here,’” Wolfson wrote.

The administration maintains the policy is legal and intended to prevent companies from “spamming the system” while ensuring top international talent can still enter.
