The Trump administration on Saturday urged the Supreme Court to reject an emergency request from the American Civil Liberties Union (ACLU) to halt deportations under the Alien Enemies Act. Solicitor General D. John Sauer asked the court to dissolve the temporary stay issued earlier in the day, which blocked removals of Venezuelan migrants held in Texas.

The administration argues the ACLU’s request is premature and improperly bypassed lower courts. Sauer claimed detainees have had time to file legal challenges and that the government has refrained from deporting anyone with pending petitions.

The Supreme Court’s brief order paused deportations under the 1798 law for migrants detained in the Northern District of Texas. That class-wide protection does not extend to other jurisdictions, where courts have separately blocked removals.

The ACLU says detainees face possible life sentences in El Salvador’s CECOT prison without judicial review. Trump officials contend the deportations are justified under the Alien Enemies Act due to alleged threats posed by the Venezuelan gang Tren de Aragua.
