The Trump administration on Thursday filed an emergency application with the Supreme Court to end deportation protections for over 600,000 Venezuelans under the Temporary Protected Status (TPS) program. The move follows a ruling from U.S. District Judge Edward Chen, who blocked the administration’s decision and criticized it as racially motivated and lacking evidentiary support.
Solicitor General D. John Sauer argued the courts have overstepped, claiming the decision to revoke TPS lies solely with the executive branch. The Department of Homeland Security, under Kristi Noem, vacated Venezuela’s TPS designation shortly after she took office, sparking outrage after she referred to migrants as “dirtbags.”
The National TPS Alliance and seven Venezuelans are suing, claiming the administration failed to follow legal procedure and acted with bias. Judge Chen noted Venezuelan TPS holders have lower crime rates and higher education levels than the general U.S. population, calling the administration’s rationale “baseless” and “predicated on generalized false stereotypes.”
Justice Elena Kagan has requested a response from plaintiffs by next Thursday.
