A transgender inmate, identified as “Maria Moe,” filed a federal lawsuit Sunday challenging a Trump executive order mandating that federal prisons house inmates based on sex assigned at birth and denying gender-affirming medical care. Signed on January 20, the order restricts federal funds from supporting “gender ideology” and prohibits transgender women from being housed in women’s prisons.
Moe’s lawsuit, filed in Massachusetts with support from GLBTQ Legal Advocates & Defenders and the National Center for Lesbian Rights, argues the order violates the Fifth and Eighth Amendments, citing discriminatory intent. Moe, recognized as female by peers and family, had been housed in a women’s facility until her records were changed on January 25.
The Federal Bureau of Prisons (BOP) previously followed Obama-era policies ensuring the safety and identity of transgender inmates. Moe now faces imminent transfer to a men’s prison under the executive order.
