Three transgender inmates filed a class action lawsuit Friday against the Trump administration and the Federal Bureau of Prisons (BOP), challenging new policies that restrict access to gender-affirming care in federal custody.
The lawsuit, filed in the U.S. District Court for the District of Columbia, argues that Trump’s Jan. 20 executive order and BOP directives violate the Eighth Amendment by denying medically necessary treatment for gender dysphoria.
The policies halt hormone therapy and surgeries, prohibit purchases of gender-affirming items, and require prison staff to use pronouns based on biological sex. Trump’s order also mandates transgender women be transferred to men’s prisons, a policy already facing three separate legal challenges.
The American Civil Liberties Union (ACLU) and Transgender Law Center are representing the plaintiffs, arguing that denying healthcare to trans inmates is as unconstitutional as withholding insulin for diabetes.
Trump’s stance on transgender rights was a major campaign issue, and his administration has aggressively rolled back legal protections for transgender individuals.
