TikTok has filed a new legal opposition against the U.S. Government’s attempts to force its sale, arguing that the bill represents “the most sweeping speech restriction in this country’s history.” TikTok and its parent company, ByteDance, claim the bill amounts to a ban, as the required parameters are impossible to meet before the law takes effect.
TikTok’s legal team asserts that the bill is not based on solid evidence but rather on the perception of a threat from a “foreign adversary.” They argue that the law fails to provide sufficient evidence of collusion between TikTok and the Chinese Government. The U.S. Justice Department, however, has claimed that TikTok has shared U.S. user data with ByteDance, which is obligated to provide such information to the Chinese government upon request.
TikTok is seeking to either dismiss the case or delay it, hoping to extend the deadline until at least 2026. This delay could potentially allow a future administration, such as a Trump presidency, to overturn the ban. The current bill is scheduled to take effect early next year.
