The Supreme Court has agreed to hear an appeal from the Biden administration regarding the regulation of ghost guns, firearms that are difficult to trace due to their lack of serial numbers. The regulation, which came into effect in 2022, expanded the definition of a firearm under federal law to include unfinished parts, allowing for easier tracking.

Despite being struck down by U.S. District Judge Reed O’Connor and upheld by a panel of the 5th U.S. Circuit Court of Appeals, the Supreme Court has allowed the regulation to remain in effect during the ongoing legal battle. The court’s decision to hear the case comes amid increasing concerns about ghost guns, with over 19,000 seized at crime scenes in 2021 alone. The case will not be argued before the fall.
