The Supreme Court on Wednesday cleared the way for President Donald Trump to remove three members of the Consumer Product Safety Commission (CPSC), lifting a lower court ruling that had temporarily reinstated the commissioners.

In a brief unsigned order, the court cited its May decision allowing Trump to fire officials from two other independent agencies, stating the CPSC is not “different in any pertinent respect.” The emergency ruling effectively lets Trump oust Commissioners Mary Boyle, Alexander Hoehn-Saric, and Richard Trumka Jr., all appointed by former President Biden, without the required “for-cause” justification outlined in federal law.

Justices Elena Kagan, Sonia Sotomayor, and Ketanji Brown Jackson dissented, warning the decision undermines agency independence and erodes the separation of powers. “This Court may facilitate the permanent transfer of authority, piece by piece, from one branch of Government to another,” Kagan wrote.

The move reflects Trump’s broader push to dismantle job protections at independent agencies, a campaign to assert greater executive control over federal governance. Solicitor General D. John Sauer urged the Court to resolve the legality of the firings outright, but the majority declined, remanding the case to lower courts.
