South Korea’s Constitutional Court on Monday overturned the impeachment of Prime Minister Han Duck-soo, reinstating him as acting leader of the nation. The court has yet to rule on the more consequential case of President Yoon Suk Yeol, who was impeached earlier over his imposition of martial law.
Seven of eight justices ruled Han’s impeachment lacked legal or procedural grounds, stating the allegations either didn’t violate the law or weren’t serious enough to justify removal. Han was impeached by the opposition-controlled National Assembly in December amid political conflict and shortly after becoming acting president due to Yoon’s suspension.
The court’s decision allows Han to resume his role as acting president, replacing Deputy Prime Minister Choi Sang-mok, who had been serving in the interim. Han pledged to focus on urgent matters, including global trade, while calling for national unity.
Yoon, who was separately arrested and charged with rebellion over martial law, awaits a verdict from the court. If upheld, his impeachment would trigger a presidential election; if dismissed, he would be reinstated.
