A coalition of 22 Republican-led states is suing New York over its new “climate Superfund” law, which requires fossil fuel companies to pay for extreme weather disaster costs. The law, modeled after the federal Superfund program, could force companies to pay up to $3 billion annually for 25 years.

The lawsuit argues that New York is overstepping its constitutional authority. “The Founders recognized that certain categories of conduct are best regulated through nationwide rules,” the suit states. West Virginia Attorney General JB McCuskey, leading the challenge, warned that similar laws could “wreck our nation’s power grid.”

States involved in the lawsuit include Alabama, Texas, Ohio, and others, along with industry groups like the West Virginia Coal Association. In contrast, New York Gov. Kathy Hochul (D) defends the law as necessary to hold polluters accountable for environmental damage.
