In the classified documents case against Donald Trump, federal prosecutor David Harbach clashed with U.S. District Judge Aileen Cannon over a request to bar Trump from making threatening comments about law enforcement agents. Special counsel Jack Smith’s team argues this is necessary after Trump falsely claimed the FBI was prepared to kill him during the Mar-a-Lago search.
Judge Cannon, a Trump appointee, questioned how to balance this request with Trump’s free speech rights and whether it could be proven that his comments directly endangered public safety. Harbach faced frequent interruptions and rebuke from Cannon, who insisted on maintaining professional decorum.
Trump’s defense lawyer, Todd Blanche, argued that the request would chill free speech and that Trump’s comments did not pose an imminent threat. The judge has yet to rule on the matter. Trump, facing numerous felony charges for hoarding classified documents, was not present at the hearing.
The case has seen delays and has been complicated by unresolved legal issues. Cannon previously postponed the trial indefinitely. Trump has pleaded not guilty to the charges.
