President Biden has exercised executive privilege to prevent House Republicans from accessing his interview recordings related to the classified documents investigation. This move came after Attorney General Merrick Garland advised the President to assert this privilege in response to subpoenas from the House Judiciary and Oversight committees.

In a letter from White House counsel Ed Siskel, he states, “Because of the President’s longstanding commitment to protecting the integrity, effectiveness, and independence of the Department of Justice and its law enforcement investigations, he has decided to assert executive privilege over the recordings.”

Special counsel Robert Hur’s extensive 345-page report recommended no legal action against Biden. However, it sparked controversy by detailing Biden’s memory lapses and portraying him as “a well-meaning, elderly man.” Hur referenced interviews with Biden’s ghostwriter Mark Zwonitzer from 2017, describing them as “painfully slow,” highlighting Biden’s difficulties in recalling past events and reading from his notes.
