A federal judge has denied California Gov. Gavin Newsom‘s emergency request to block Donald Trump from deploying federalized military forces to enforce immigration law in Los Angeles.

U.S. District Judge Charles Breyer declined to issue a temporary restraining order on Tuesday but scheduled a hearing for later in the week. The Trump administration now has until Wednesday to respond to the suit, which argues that deploying active-duty Marines and federalized National Guard members in civilian areas is unconstitutional.

Newsom’s filing warned of “devastating consequences” and accused the administration of importing a “warrior culture” into American cities. In a televised address, Newsom claimed the nation is on the brink of authoritarianism. “Democracy is under assault right before our eyes,” he said.

The deployment follows large protests sparked by recent immigration raids. Newsom emphasized that the legal filing does not challenge troops protecting federal property, only their use in policing civilian areas.

The administration dismissed Newsom’s legal arguments as “meritless,” maintaining the president’s authority to restore order under federal law.
