A Montana court ruled three abortion restriction laws unconstitutional, including a post-20-week ban. Judge Kurt Krueger cited undue burdens on access without solid evidence.

The 2021 laws, also restricting telehealth medication abortions and imposing a 24-hour wait, remain unenforceable due to a 2021 injunction. This aligns with Montana’s 1999 Supreme Court privacy protection for pre-viability abortions.

Despite plans for an appeal by Attorney General Austin Knudsen, the decision was praised by Planned Parenthood as a key victory for abortion access in Montana. Further legislative restrictions continue to face legal challenges.
