Liz Cheney, former congresswoman and co-chair of the House January 6 committee, is urging the US Supreme Court to quickly rule on Donald Trump’s claim of immunity from prosecution for acts committed during his presidency. Cheney’s call comes in anticipation of Trump’s 2020 election interference trial, which she hopes can begin before the 2024 election.
Cheney expressed concern that if the case is delayed, the public may never hear the evidence developed before the grand jury, and the person most responsible for the January 6 attack may not be held accountable. Trump faces four federal election subversion charges related to his attempt to overturn his defeat by Joe Biden in 2020.
Cheney, a Republican, has been a vocal critic of Trump and was ousted from her congressional seat after demanding accountability for the January 6 insurrection. She has expressed preference for Democrats to win in the 2024 elections over her own party, citing fears of the US “sleepwalking into dictatorship.”
In her New York Times article, Cheney argued that if Trump’s tactics prevent his trial from proceeding, he will have succeeded in concealing critical evidence from the American people. She urged the Supreme Court to understand this reality and conclude without delay that no immunity applies in this case.
Trump and his team have urged the court to find that presidents have absolute immunity from criminal prosecution for official acts they take in office, thereby dismissing the federal criminal case. The court, which leans conservative, will hear oral arguments in the immunity case on Thursday.
