Former U.S. Attorney Joyce Vance believes Judge Aileen Cannon’s ruling in favor of Donald Trump in the federal classified documents case could be overturned on appeal. In her legal blog, Civil Discourse, Vance analyzed the 58-page brief filed by Special Counsel Jack Smith, who argued that Cannon’s decision to dismiss the charges was flawed.

Cannon had ruled that Smith’s appointment as special counsel was unconstitutional, prompting an appeal from the Department of Justice. Vance highlighted that Smith’s brief cited multiple legal precedents, including United States v. Nixon, to argue that Attorney General Merrick Garland had the authority to appoint Smith. Vance suggested that the appellate court is likely to reverse Cannon’s ruling, but noted uncertainty remains if the case reaches the U.S. Supreme Court. The appeal is expected to be heard later this year, with no hearing dates set.
