U.S. District Judge Tanya Chutkan denied former President Donald Trump’s motion to dismiss the election subversion case against him, rejecting claims of vindictive and political prosecution. Trump argued that his prosecution was unfair compared to others who challenged election results and alleged that it was a political move by President Biden and the Justice Department to block his reelection.
Chutkan, in her first substantive order since the Supreme Court’s landmark decision, clarified that Trump was charged for “knowingly making false statements in furtherance of criminal conspiracies and for obstruction of election certification proceedings,” not merely for challenging election results. She dismissed claims of political motivation, stating that Trump’s defense had not demonstrated actual vindictiveness.
The judge scheduled an Aug. 16 status conference to discuss the case’s next steps. Trump faces a four-count indictment from August 2023, accusing him of attempting to overturn the 2020 election results. The Supreme Court’s decision provided former presidents broad immunity but left it to Chutkan to determine the scope of Trump’s actions that could be prosecuted.
