A federal judge has blocked President Trump‘s executive order mandating proof of citizenship to register to vote, ruling it unconstitutional and beyond presidential authority.
U.S. District Judge Colleen Kollar-Kotelly issued a 120-page opinion stating that the requirement contradicts the National Voter Registration Act, where Congress had explicitly rejected such a provision. “The President has no constitutional power over election regulation that would support this unilateral exercise of authority,” the judge wrote.
The executive order, signed last month, also threatened to cut federal election funding from states that did not comply. Kollar-Kotelly barred the Election Assistance Commission from enforcing those penalties.
The ruling comes as the House recently passed the Safeguard American Voter Eligibility (SAVE) Act, which would require proof of citizenship to vote in federal elections. While noncitizen voting is illegal and rare, the bill has become a flashpoint in ongoing partisan battles over election integrity.
