Illinois filed a federal lawsuit Monday against President Donald Trump and Homeland Security Secretary Kristi Noem, accusing the administration of unlawfully deploying federalized National Guard troops into the state against Gov. J.B. Pritzker’s objections. The lawsuit follows Trump’s order sending 400 members of the Texas National Guard to Illinois and other states to “ensure safety for federal officials.”
The administration cited a federal statute permitting deployments in cases of invasion or rebellion. However, Illinois argues the move exceeds presidential authority under the Posse Comitatus Act, which restricts using military forces for domestic law enforcement.
Earlier court rulings in California and Oregon have questioned similar deployments. U.S. District Judge Charles Breyer found Trump’s previous actions in California a “serious violation” of the law, while another judge temporarily blocked troop deployment to Oregon.
Pritzker condemned the federal actions as “Trump’s invasion,” calling them unconstitutional and unnecessary amid small protests near immigration facilities.
