Hunter Biden’s lawyers have requested a new trial, arguing that the Delaware court lacked jurisdiction in his case. Biden was found guilty on June 11 of three felony charges for lying about his drug use on a 2018 federal gun-purchase form, which would have disqualified him from buying the gun.
In a motion filed Monday, Biden’s lawyers did not contest the case’s merits but claimed the court was “divested of jurisdiction” due to unresolved appeals. Attorney Abbe Lowell cited that the judge had not issued a formal mandate denying one of Biden’s appeals, arguing that district court actions taken without jurisdiction should be vacated.
Additionally, Biden’s legal team referenced a recent Supreme Court ruling in U.S. v. Rahimi, which upheld a federal ban on gun ownership by domestic abusers but rejected disarmament based solely on drug use. They argue this ruling supports an acquittal or new trial for Biden, as there was no judicial finding of his “dangerousness.”
A sentencing date has not been set. Biden faces a maximum of 25 years in prison but could receive up to 21 months as a first-time offender under federal guidelines.
