The Georgia Supreme Court announced Thursday it will hear a high-stakes legal dispute between Fulton County District Attorney Fani Willis and the Republican-led Georgia Senate over whether Willis can be compelled to testify and hand over documents.

The case stems from subpoenas issued last August by the Senate Special Committee on Investigations, which is probing Willis’s prosecution of former President Donald Trump and others over alleged efforts to overturn Georgia’s 2020 election results. Willis, a Democrat, argues the committee lacks authority and that its demands are overly broad.

A Fulton County Superior Court judge ruled in December that the Senate panel does have subpoena power. Willis appealed, and the state’s highest court has scheduled oral arguments for October.

The legal fight adds to Willis’s mounting challenges. She was disqualified from the Trump case late last year due to a past romantic relationship with her lead prosecutor and is now awaiting a ruling on her appeal to remain on the case.

With her office sidelined, the prosecution of Trump and his co-defendants is in limbo unless another county district attorney steps in.
