A Georgia judge denied a bid by former President Donald Trump and his co-defendants to dismiss state election interference charges on First Amendment grounds. Fulton County Superior Court Judge Scott McAfee ruled that their right to protest the 2020 presidential election results did not protect them from the charges brought by District Attorney Fani Willis’s office.
Trump and his co-defendants, including his former lawyers Rudy Giuliani and John Eastman, argued that the prosecution violated the First Amendment’s protections of political speech and activity, freedom of association, and the right to petition Congress. However, Judge McAfee found that these constitutional protections did not extend to the defendants’ alleged actions and statements.
Despite the ruling, Trump’s lawyer, Steve Sadow, stated that they respectfully disagree with Judge McAfee’s order and will continue to evaluate their options regarding the First Amendment challenges. Trump and 14 other defendants in the racketeering case have pleaded not guilty.
