Fourteen states, led by New Mexico, filed a lawsuit against Elon Musk and the Department of Government Efficiency (DOGE), alleging Musk’s authority is unconstitutional. The lawsuit, filed in Washington, D.C., seeks to block Musk from canceling government contracts or altering federal spending.
State attorneys argued that Musk, with President Donald Trump’s approval, has “unraveled agencies, accessed sensitive data, and caused chaos” without oversight. Trump established DOGE to cut government waste and fraud, appointing Musk to lead the effort. Critics claim Musk and his team, including young engineers, improperly accessed sensitive government information.
The lawsuit cites DOGE’s involvement with the Treasury Department, USAID, and other agencies as violating the Constitution’s appointments clause, which requires Senate confirmation for top officials. Musk defended his role, stating, “Your tax dollars need to be spent wisely.”
This adds to 63 lawsuits challenging Trump’s rapid executive actions, including federal layoffs and spending freezes. Blue and purple states, including California, Massachusetts, Nevada, and Arizona, have joined the legal fight.
