A flag associated with the Jan. 6, 2021, U.S. Capitol riot was displayed outside a home owned by Supreme Court Justice Samuel Alito, according to The New York Times. Photos from neighbors and Google Street View show an “Appeal to Heaven” flag flying outside Alito’s beach house in Long Beach Island, New Jersey. The flag, which dates to the Revolutionary War and features a green pine tree on a white background, is now linked with Christian nationalists and Trump supporters.

A Google Maps image from August 2023 shows the flag outside a home identified by the Times as Alito’s. The Supreme Court has not commented on the matter.

Previously, a New York Times investigation reported an upside-down American flag—symbolizing Trump’s “Stop the Steal” movement—was flown outside Alito’s Alexandria, Virginia, home on January 17, 2021. This occurred shortly after the Capitol riot and while the Supreme Court was hearing cases about the 2020 election integrity. Alito stated he had no involvement with the upside-down flag, explaining it was placed by his wife in response to a neighbor dispute.

The flag displays have led some Democrats to call for Alito to recuse himself from cases related to the Jan. 6 attack, citing potential political bias. Senator Lindsey Graham also criticized the decision to fly the upside-down flag as poor judgment. Two cases concerning Jan. 6, including Trump’s immunity claims, are currently pending before the Supreme Court.
