WASHINGTON, D.C. — The FBI subpoenaed phone records belonging to Kash Patel and Susie Wiles during 2022 and 2023 as part of investigations tied to President Donald Trump, according to statements Patel provided to Reuters.

Patel, now serving as FBI director, said investigators obtained what are known as “toll records,” which detail the timing and recipients of phone calls but do not include call content. The subpoenas were issued during Special Counsel Jack Smith’s probe into Trump’s handling of classified documents at Mar-a-Lago and alleged interference related to the 2020 election.

Reuters reported it could not independently verify many of Patel’s claims, including the full scope of the records obtained or who approved the subpoenas. Patel said the records were filed under a “Prohibited” classification, which he recently eliminated, arguing the designation made them difficult to locate within FBI systems.

Investigators routinely subpoena phone metadata during criminal probes, and such records can be obtained without a judge’s approval. Democrats have previously defended Smith’s investigative methods as lawful and necessary.

Smith declined to comment. Neither former Attorney General Merrick Garland nor former FBI Director Chris Wray responded to requests for comment.
