Washington, DC — The U.S. Department of Education formally rescinded the Biden administration’s Title IX interpretation protecting students from sex discrimination based on sexual orientation and gender identity, returning schools to regulations adopted during President Donald Trump’s first term.
The department said Monday that the move restores the 2020 Title IX rule and brings federal regulations into line with court decisions that struck down the Biden administration’s 2024 expansion. Education Secretary Linda McMahon said the change would reduce confusion for schools while protecting women’s athletic opportunities and privacy.
The Biden-era rule had interpreted Title IX’s prohibition on sex discrimination to include sexual orientation and gender identity. Republican-led states challenged that interpretation, and federal courts ultimately blocked the regulation before Trump returned to office.
Since taking office again, the administration has pursued a narrower definition of sex under federal education law and has pressured schools to restrict transgender athletes from women’s sports programs. The department has also rescinded earlier civil-rights agreements involving gender identity.
LGBTQ and women’s-rights advocates argue the rollback could leave transgender students more vulnerable to discrimination and weaken protections for some survivors of sexual harassment or assault. The administration maintains that existing Title IX protections remain intact for discrimination based on biological sex.
