Senate Judiciary Committee Chair Dick Durbin (D-Ill.) has urged Justice Samuel Alito to recuse himself from cases related to the 2020 election and the Jan. 6, 2021, incident. This follows reports of an upside-down American flag, a symbol associated with the ‘Stop the Steal’ movement, flown outside Alito’s home. Alito denies involvement, attributing the act to his wife, Martha-Ann, due to a neighborhood dispute.
The call for recusal comes as the Supreme Court prepares to rule on key Jan. 6-related cases, including former President Trump’s immunity from prosecution. Durbin argues that the flag incident creates an appearance of bias. He further criticizes the Supreme Court for its ethical crisis and advocates for legislation to establish a code of conduct for justices.
Justice Clarence Thomas has also faced recusal calls due to his wife’s involvement in efforts to overturn the 2020 election result. Durbin’s push for a new ethics code for justices follows revelations of lavish gifts and vacations received by some justices, including Thomas and Alito, from wealthy donors. The court has resisted these proposals, asserting that Congress lacks the authority to impose rules on justices.
