Washington, D.C. – Rep. Nancy Mace (R-S.C.) introduced a proposed constitutional amendment Wednesday that would limit members of Congress, federal judges, and Senate-confirmed executive branch officials to natural-born U.S. citizens.
The proposal would expand existing constitutional rules that already require presidents to be natural-born citizens. If adopted, the amendment could disqualify certain naturalized citizens from serving in Congress, federal courts, or Cabinet-level positions.
Mace specifically referenced several foreign-born Democratic lawmakers, including Reps. Ilhan Omar, Pramila Jayapal, and Shri Thanedar, arguing that some elected officials demonstrate loyalties outside the United States. She did not provide evidence supporting those claims.
Democrats and immigrant advocacy groups quickly condemned the proposal as discriminatory and politically motivated. The Congressional Asian Pacific American Caucus noted the amendment could also affect Republican lawmakers and officials who immigrated to the United States before entering public service.
Legal experts say the proposal faces extremely long odds because constitutional amendments require approval by two-thirds of both chambers of Congress and ratification by three-fourths of U.S. states.
