A new court filing from the Trump administration has provided the most detailed explanation yet of Elon Musk’s position within the federal government. The filing, submitted late Monday, comes in response to a lawsuit filed by Democratic attorneys general seeking to block Musk and the Department of Government Efficiency (DOGE) from accessing sensitive data and influencing federal firings.
During a virtual hearing, Judge Tanya Chutkan pressed the government on how many employees DOGE has ordered to be terminated and how many more cuts are expected. Government attorneys were unable to provide a clear answer, stating only that “a number” of employees had been let go.
The Justice Department argues that Musk has “no actual or formal authority” to make personnel decisions and works under the White House rather than DOGE itself. However, the administration has not clarified who officially oversees DOGE’s operations. The White House has yet to respond to requests for comment.
