President Biden predicted on Wednesday that the next president will have the opportunity to appoint two new Supreme Court justices, while warning against a potential return of former President Trump.

“Guess what, the next president, they’re going to be able to appoint a couple of justices and I’ll be damned—” Biden said at a rally in Philadelphia.

The event at Girard College marked the launch of Black Voters for Biden-Harris, aimed at mobilizing support in the Black community. Biden emphasized the importance of adding progressive judges to the Supreme Court if reelected.

“Look, if in fact they’re able to change some of the justices when they retire and put in some really progressive judges, like we’ve always had, tell me that won’t change your life when Trump justices are already gutting voting rights, overturning Roe, decimating affirmative action, and so much more,” he said. “We’re going to let that happen? We can’t. No, we really can’t.”

Biden’s comments come amid calls from left-wing activists for Justice Sonia Sotomayor, 69, to step down while Democrats control the White House and Senate. These calls aim to avoid a repeat of Justice Ruth Bader Ginsburg’s situation, who died in 2020 during the Trump administration, leading to the appointment of her conservative successor.

The oldest current justice, Clarence Thomas, is 75. The second oldest, Samuel Alito, 74, faces calls to recuse himself from cases related to the 2020 election and the Jan. 6 Capitol riots after reports of “Stop the Steal” flags flown outside his homes. Alito told lawmakers he will not recuse himself, claiming no involvement with the flags.

The Biden campaign has not commented on which justices the president expects to leave the court in the coming years.
