The Biden administration is set to propose a change to asylum rules that could expedite deportations for certain migrants. This incremental shift, which applies to individuals deemed ineligible for asylum due to national security risks, could lead to earlier deportations in the lengthy review process.
This proposal, first reported by Axios and Politico, is yet to be published and will undergo a formal comment period before finalization. The move comes as the White House explores executive actions following the Senate’s withdrawal from a compromise on legislation that would have allowed the administration to reject asylum seekers once certain thresholds were met.
President Biden had previously stated that such legislation would enable him to “shut down the border” and halt new asylum claims when migrant numbers exceed the processing capacity of border officials. While there have been media speculations about Biden implementing this measure through an executive order, this particular action does not extend that far and does not alter the rules regarding who is denied asylum.
