Immigration attorneys on Tuesday accused the Trump administration of violating a federal court order by deporting a group of migrants to South Sudan, a country they have no ties to. The urgent court filing asks U.S. District Judge Brian Murphy, a Biden appointee based in Boston, to order the migrants’ return.
Murphy’s April injunction requires notice in a language migrants understand and a chance to raise persecution claims before removal to third countries. The filing says those requirements were ignored when at least two individuals—a Burmese and a Vietnamese national—were flown to South Sudan. Attorneys suspect up to ten migrants were aboard.
The court document cites South Sudan’s return to civil war and references the recent case of Kilmar Abrego Garcia, who was mistakenly deported to El Salvador and later ordered returned by the Supreme Court.
The legal team includes Human Rights First, the National Immigration Litigation Alliance, and the Northwest Immigrant Rights Project. A hearing on related deportation practices is set for Wednesday.
