The Arizona Supreme Court dismissed a lawsuit from an anti-abortion group on Tuesday, allowing a measure that would protect abortion rights under the state Constitution to appear on the November ballot. The court upheld a lower court ruling that found the 200-word summary of the initiative used for voter education and signature collection was accurate and not misleading.
The court’s five-page opinion affirmed that the summary clearly described the initiative’s key provisions, including establishing a fundamental right to abortion, defining the scope of this right before and after fetal viability, and preventing the state from penalizing those who assist in exercising this right.
This decision marks a significant victory for Democrats, who aim to enshrine abortion protections in Arizona’s Constitution. Arizona Secretary of State Adrian Fontes confirmed the initiative had sufficient valid signatures to qualify for the ballot. Arizona for Abortion Access celebrated the ruling, stating that voters will have the chance to vote “YES” on Proposition 139 this fall to secure abortion rights in the state.
