ATLANTA, GA — The Eleventh Circuit Court of Appeals has directed U.S. District Judge Aileen Cannon to issue a ruling within 60 days on pending motions to release Volume II of Special Counsel Jack Smith’s final report in the classified documents case involving former President Donald Trump. The court cited “undue delay” after Cannon postponed decisions on the motions for months.

The petitions, filed by the Knight First Amendment Institute at Columbia University and American Oversight in February, seek public access to the report, which remains sealed despite Smith’s investigation concluding earlier this year. Both motions were fully briefed by early July.

In an unsigned order, a three-judge panel criticized the delay, warning it could intervene if no ruling is made within the 60-day window. Critics, including Knight Institute director Jameel Jaffer, said the report’s continued suppression “undermines accountability,” while American Oversight’s Chioma Chukwu called for immediate release.

The decision marks the latest development in efforts to obtain documents related to Trump’s alleged mishandling of classified materials, a case largely considered closed following Smith’s final filings earlier this year.
