The American Civil Liberties Union (ACLU) filed a new legal challenge Monday against President Donald Trump‘s use of the Alien Enemies Act to expedite migrant deportations, this time focusing on two Venezuelan men detained in Colorado.
The suit, filed in Denver federal court, seeks to block the administration from deporting the men under the 1798 law, which permits deportations during wartime or invasions. Trump argues it applies due to the alleged threat posed by the Venezuelan gang Tren de Aragua. Both detainees deny any affiliation with the gang.
The case comes after the Supreme Court ruled last week that deportation challenges must be filed in the jurisdiction where a migrant is detained but affirmed that migrants must have time to legally contest removal. The ACLU argues the government’s 24-hour notice policy fails to meet that standard.
Judges in New York and Texas have already issued temporary blocks on similar deportations. The Colorado case is assigned to U.S. District Judge Charlotte Sweeney, a Biden appointee.
