Fifteen states filed a federal lawsuit against the Biden administration over a rule allowing 100,000 immigrants, known as “Dreamers,” to enroll in the Affordable Care Act (ACA). The states seek to block the rule before it takes effect on November 1, arguing it violates a 1996 welfare reform law and the ACA itself. They claim the rule will burden states by encouraging illegal immigration and increasing costs for public services.

Kansas Attorney General Kris Kobach, a long-time immigration hardliner, stated, “Illegal aliens shouldn’t receive taxpayer benefits when they arrive.” The lawsuit, filed in North Dakota, includes states with Republican attorneys general, all opposing Biden administration policies.

The Biden administration defends the rule as support for Dreamers, with Biden stating he’s “committed to providing Dreamers the support they need to succeed.” Dreamers, who were brought to the U.S. illegally as children, have been ineligible for government-subsidized health insurance until now.
