Kilmar Abrego Garcia, a Maryland man wrongly deported to El Salvador in March, was returned to the U.S. Friday to face federal human trafficking charges, Attorney General Pam Bondi confirmed. The deportation, acknowledged by the Trump administration as an “administrative error,” sparked national outrage and a legal standoff over immigrant due process.
Abrego Garcia was sent to CECOT, El Salvador’s notorious mega-prison, despite having deportation protections since 2019. A federal court and the U.S. Supreme Court ordered his return, but the Trump administration resisted. On Friday, Trump told reporters, “It’s a disaster. He should never have had to be returned.”
Bondi said Abrego Garcia now faces a 10-page federal indictment in Tennessee for allegedly smuggling migrants. His attorney, Chris Newman, questioned the charges’ legitimacy, calling for a fair trial. The indictment alleges that those transported included members of the MS-13 gang and that he worked with co-conspirators.
Sen. Chris Van Hollen, who advocated for Abrego Garcia’s return, emphasized the case’s constitutional stakes. “This is not about the man,” he said, “it’s about his rights—and the rights of all.”
Abrego Garcia’s arraignment is set for Friday.
