Chicago, IL — A Chicago woman shot multiple times by a Border Patrol agent during last year’s immigration crackdown has sued the federal government, alleging the agent fired from behind her vehicle and later gave a false account of what happened.

Marimar Martinez filed the lawsuit Monday under the Federal Tort Claims Act. She accuses the government of negligence, battery, assault, false arrest, malicious prosecution and emotional distress stemming from the Oct. 4, 2025, shooting during Operation Midway Blitz.

Federal prosecutors initially accused Martinez of using her vehicle to strike and box in Border Patrol agent Charles Exum’s SUV. Exum then opened fire, leaving Martinez with seven gunshot wounds. Prosecutors later dropped the charges against her after body-camera footage and other evidence raised questions about the government’s original account.

Martinez’s attorneys commissioned a forensic reconstruction they say shows Exum was beside or behind her vehicle rather than directly in its path when he fired. The analysis has not been tested in court, and the federal government has not admitted wrongdoing.

Exum remains on administrative leave, while Chicago police are separately investigating the shooting.
