New York, New York — The mother of a 5-year-old is asking the Supreme Court to let her son remain enrolled in kindergarten while she challenges New York’s refusal to provide religious exemptions from school vaccination requirements.

The mother, identified in court filings as Jane Doe, filed an emergency application seeking temporary relief for her son, C.F., who attends the Waverly School. She argues that Section 2164 of New York’s Public Health Law violates her religious rights by allowing medical exemptions while categorically excluding religious ones.

Doe cited recent Supreme Court decisions involving parental rights and religious exercise, including Mahmoud v. Taylor and an emergency ruling involving California school policies.

New York officials urged the justices to reject the request, arguing the vaccination requirement is a neutral public-health measure designed to reduce the spread of communicable disease in schools. They said the law applies broadly and does not target religious beliefs.

State and school officials also argued the dispute may be moot because Doe had discussed moving her son to Florida. Doe countered that the issue remains active because her son faces a Sept. 16 deadline to comply with the vaccination requirement or leave the school.

The Supreme Court requested responses from New York and the school but has not set a timetable for ruling on the emergency application.
