The U.S. Justice Department filed a federal lawsuit Friday against Fulton County Clerk of Court Che Alexander, alleging her office failed to provide records from the 2020 general election despite multiple subpoenas and demand letters. According to the complaint, the department issued a subpoena on October 6, followed by additional demands on October 30 and November 21, none of which produced the requested documents.

Alexander’s office responded on November 14 that the records were under seal and could not be released without a court order, a position the DOJ disputes. The lawsuit argues that the county’s refusal violates the Civil Rights Act, which requires election records be preserved and made available for federal inspection. The Justice Department is asking the court to compel Fulton County to turn over the documents within five days.

Fulton County is one of four jurisdictions sued Friday, with Colorado, Hawaii, Massachusetts, and Nevada also accused of failing to comply with federal record requests. The case follows a July 2025 referral from the Georgia State Election Board, which said it had been seeking the same records since 2024.

Assistant Attorney General Harmeet K. Dhillon said the department would not allow states or localities to “jeopardize the integrity and effectiveness of elections” by refusing to follow federal law. The Fulton County Clerk’s Office did not immediately respond to a request for comment.
