TALLAHASSEE, Florida — The Florida Supreme Court has ordered Circuit Judge J. Layne Smith to appear for a public reprimand after he told attorneys during a contentious hearing that he would like a deputy to “pull his gun and shoot all three of you.”
The court unanimously accepted the Florida Judicial Qualifications Commission’s recommended discipline Thursday, saying Smith’s conduct “fell far below the standard of professionalism” expected of judges. Smith serves Florida’s Second Judicial Circuit and was appointed to the bench by Gov. Ron DeSantis in 2020.
The incident occurred during a September 2025 hearing in a long-running family dispute. Frustrated that attorneys could not confirm whether a party had been properly served, Smith made the shooting remark before immediately adding that he did not actually want the deputy to do so. He also mocked the lawyers as the “Keystone Cops” and “Apple Dumpling Gang.”
The Judicial Qualifications Commission found that Smith violated six judicial ethics provisions. Rather than contest the allegations, Smith acknowledged the misconduct, self-reported his behavior and agreed to the proposed punishment.
Smith recused himself from the underlying case about a week after the hearing and later issued a public apology. The Supreme Court did not suspend or fine him, but ordered him to appear personally for the reprimand at a date to be scheduled.
