Ithaca, NY — A criminal investigation into an alleged 2024 gang rape at Cornell University has been reopened after a former student filed a civil lawsuit accusing seven Chi Phi fraternity members of sexually assaulting her over several hours. Prosecutors say the new allegations differ substantially from what was initially reported to police.
Tompkins County District Attorney Matthew Van Houten said his office intends to present the case to a grand jury with the cooperation of the woman, identified in court filings as Jane Doe. He said investigators will examine whether new evidence exists that could change the earlier decision not to pursue criminal charges.
The lawsuit alleges the woman was drugged and repeatedly assaulted at the Chi Phi fraternity house in October 2024. It also claims two fraternity members were expelled while others received lesser university sanctions. No one was arrested or criminally charged following the original investigation.
Van Houten said the woman’s 2024 statement to police described circumstances differently, including her use of alcohol and drugs and the nature of the sexual activity. Her attorney has argued that authorities failed to properly follow up with a traumatized sexual-assault survivor.
Cornell has said the allegations are deeply disturbing and that its Title IX process resulted in sanctions including expulsions and suspensions. The university also said the Chi Phi chapter remains barred from campus.
