U.S. Special Counsel Jack Smith has requested the Supreme Court to expedite the decision on former President Donald Trump’s immunity regarding charges of conspiring to overturn his 2020 election loss. Smith aims to keep Trump’s trial, scheduled for March 4, on track, bypassing the lengthy appellate process. The Supreme Court has agreed to hear arguments on this issue, with Trump’s lawyers to submit briefs by December 20.

The request to the Supreme Court is an effort to prevent delays that could push the trial past the 2024 presidential election. Trump, who is facing four criminal indictments for 91 offenses, remains a strong contender for the 2024 Republican presidential nomination. If re-elected, he could influence the outcome of his ongoing legal challenges.

The Supreme Court’s involvement follows its history of rulings against Trump’s legal defenses, including rejecting his 2020 election challenges and denying his claims of presidential immunity from investigations.

At the center of the case is whether a former president can claim absolute immunity from federal prosecution for crimes committed while in office. The trial judge, U.S. District Judge Tanya Chutkan, has dismissed Trump’s immunity claims, stating that former presidents have no special conditions regarding federal criminal liability.

Trump is accused of conspiring to disrupt the certification of the 2020 election results, culminating in the January 6 Capitol riots. Over 1,100 protesters were arrested, with more than 600 convictions. The Supreme Court’s decision on Trump’s immunity claims is pivotal in determining the course of the trial.
