The Texas Supreme Court overturned a lower court’s decision that would have allowed Kate Cox, a pregnant woman, to get an emergency abortion under the state’s near-total abortion ban. The unanimous ruling stated that a doctor’s belief in the medical necessity of an abortion isn’t enough to qualify for the state’s exception. The Court emphasized the need for a doctor’s “reasonable medical judgment” to identify a life-threatening condition justifying an abortion.
Cox, who had already left Texas to obtain the abortion, pursued the case citing a fatal fetal diagnosis and health risks. The ruling is a critical evaluation of Texas’ medical exception for abortions and rejects the argument that a physician’s good faith belief meets the exception criteria.
Attorney General Ken Paxton, who sought the Supreme Court’s intervention, argued against liberal court-granted abortion permissions.
